<p>The following letter went out this morning concerning the Tall Building Guidelines.</p>

<p>Planning and Growth Management Committee has recommended City Council approve the Tall Building Guidelines to be applied across the City; delegate future amendments of the Guidelines to the Chief Planner and request the Chief Planner to develop a framework for a Development Permit System for height.</p>
<p>&nbsp;</p>
<p>These issues if approved has the effect of delegating Council authority to a select few.  Our communities would be at risk with Council having abdicated their powers to decide.</p>
<p>&nbsp;</p>
<p>If you have a chance today, please write asking that Council respect the OP Policies and not to delegate their authority on planning matters.</p>

<p><b>Re:      PG23.5 Updated City-Wide Tall Building Design Guidelines</b></p>
<p><b>City Council Meeting No. 33 May 7 &amp; 8, 2013</b></p>
<p>&nbsp;</p>
<p>CORRA, the Confederation of Resident and Ratepayer Associations in Toronto, is asking Members of Council to hold down PG23.5 City-wide Tall Building Guidelines for a full debate.</p>
<p>&nbsp;</p>
<p>Do not pass this agenda item by consent.  Doing so will put communities in your Ward at risk and potentially hand over Council’s authority to a delegated few.</p>
<p>&nbsp;</p>
<p><b>CORRA asks Council to amend PGM Committee</b></p>
<p><b>Recommendation 1:</b></p>
<p>·         That The Tall Building Design Guidelines and the Downtown Tall Buildings: Vision and Supplementary Design Guidelines (Tall Building Guidelines) be restricted to the Downtown Core;</p>
<p>·         the two Guidelines remain as guidelines as stated in OP 5.3.2 Policy 1 in its entirety (any references within the Guidelines that suggest equivalency or greater status to OP Policies, Zoning By-law, Area Specific By-laws or Secondary Plans should be deleted); and</p>
<p>·         any intended OP inclusion in whole or in part of the Guidelines requires an OP amendment that will meet/exceed the statutory requirements of the Planning Act and the OP.</p>
<p>&nbsp;</p>
<p><b>Recommendation 2:</b></p>
<p>CORRA asks that Council not abdicate their authority and recommend that any subsequent amendments to the Guidelines as outlined above including “administrative changes related to City policies, plans, guidelines and planning implementation tools” are to be considered at Planning and Growth Management Committee with Notice and following a Committee recommendation be referred to Council for final approval.  It is from the Public Notice and from Council’s Approval that make such Guidelines express Council Policy.</p>
<p>&nbsp;</p>
<p><b>Recommendation 3:</b></p>
<p>CORRA asks that Council direct the Chief Planner and Executive Director prepare a Report with input from Legal Services identifying the requirements of a Development Permit System according to Ontario Regulation 608/06 Development Permits and the City’s OP to Planning and Growth Management Committee with Notice for public input.</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p><b>Background:</b></p>
<p>The Tall Building Guidelines were prepared based on the City’s Downtown context, where tall buildings in the downtown core is supported by the City’s Official Plan.</p>
<p>&nbsp;</p>
<p>The Tall Building Guidelines were brought forward under public realm and urban design consideration which generally do not follow the rigour of statutory meetings and Notice as required by the Planning Act or the Official Plan before such guidelines are adopted by Council.</p>
<p>&nbsp;</p>
<p>This is because the City OP Section 5.3.2 Policy 1 state:</p>
<p>&nbsp;</p>
<p>“Implementation plans, strategies and guidelines will be adopted to advance the vision, objectives and policies of this Plan. These implementation plans, strategies and guidelines, while they express Council policy, are not part of the Plan unless the Plan has been specifically amended to include them, in whole or in part, and do not have the status of policies in this Plan adopted under the Planning Act.”</p>
<p>&nbsp;</p>
<p>Please find attached OP Section 5.3.2 Policy 1 for your reference.</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>To include any part the Tall Building Guidelines in the OP constitutes an OP amendment that will need to meet the statutory requirements of the Planning Act and the OP.</p>
<p>&nbsp;</p>
<p>The development of Tall Building Guidelines largely involved stakeholders from the building Industry and land development groups and some residents living within the Downtown core.   There were no oral deputations or written submissions from resident groups on this agenda item.</p>
<p>&nbsp;</p>
<p>Applying these guidelines to the broader City without considering the context and the views of residents living outside the downtown core does not meet the essence of what planning is all about.</p>
<p>&nbsp;</p>
<p>With respect to the Development Permit System (DPS), it appears the information is not provided in the Staff Report.  There are two areas in the City’s OP where the DPS is mentioned:</p>

<td valign="top">“Policies will be adopted as part of the Plan with respect to the passing of by-laws to implement a Development Permit System.”</p>

<td valign="top">“An implementing zoning by-law and/or development permit by-law will be prepared concurrently for new Secondary Plans unless Council determines that development is to proceed by site specific zoning.”</td>

<p>Ontario Regulation 608/06 Development Permits</p>
<p>(<a href="http://www.e-laws.gov.on.ca/html/regs/english/elaws_regs_060608_e.htm#BK2">http://www.e-laws.gov.on.ca/html/regs/english/elaws_regs_060608_e.htm#BK2</a>) must be considered to ensure all the regulatory conditions are met.</p>
<p>&nbsp;</p>
<p>The City of Toronto Act weighs in with respect to the delegation of powers.  The DPS is not a system that remains outside the normal governing framework of the existing planning decision-making process—it requires OP policy; a by-law; and is informed by a separate provincial regulation.  And depending how the system is structured it is a delegation of Council authority.</p>
<p>&nbsp;</p>
<p>In summary, CORRA seeks Council not to abdicate its responsibilities and to respect the City’s Official Plan Policies.  CORRA’s recommendations are consistent with the OP.  CORRA asks for a fair, open and meaningful dialogue for resident and ratepayer associations concerning all planning matters.</p>

<p>The City&#8217;s 3rd annual Clean Toronto Together event is fast approaching.  For quick reference, here are the key dates:</p>

<p>Everyone is invited to participate in Toronto&#8217;s annual spring clean up which takes place in April. On Saturday, April 20th, residents are encouraged to participate in Mayor Rob Ford&#8217;s Community Clean-up Day by joining with family, friends and neighbours to clean a public space that&#8217;s near and dear to your heart, such as a local park, street or ravine. Participants can also report graffiti vandalism and illegal postering by calling 311. Students and businesses will participate on Friday, April 19.</p>
<p>&nbsp;</p>
<p>Participants can pick up GLAD garbage and recycling bags at Community Centres, Civic Centres and all Toronto Pizza Pizza locations starting April 2, while supplies last.</p>
<p>&nbsp;</p>

				<content:encoded><![CDATA[<p><strong>NEW HARMONIZED ZONING BY-LAW</strong></p>
<p><strong>KEY GENERAL ISSUES FOR YOUR CONSIDERATION</strong></p>
<p>These were raised and discussed at the last CORRA Council Meeting. Below is a brief summary:</p>
<p>FOR ALL NEIGHBOURHOODS</p>
<p>Exemption for Mechanicals in the Roofs</p>
<p>1. Exemption for 20 sq. m. in the attic for mechanical uses. See10.5.40.40 (2) and</p>
<p>10.20.40 (8). Effectively you can have a 200 Sq. Ft. Box regardless of the size of your</p>
<p>building exempt from the max number of storeys or from Floor Space Index.</p>
<p>The by-law allows a 10 sq. m. exemption for fsi of attics. For houses under 100 sq. m.</p>
<p>that should be more than enough. There is no equivalent issue where there are limits</p>
<p>on the number of storeys.</p>
<p>ISSUE: A builder can label an area in the attic for mechanical purposes for the</p>
<p>building permit and then go to the Committee of Adjustment for a variance to request</p>
<p>it be turned into habitable space and argue that the massing is the same.</p>
<p>POSSIBLE SOLUTION: This creates a loop hole which is not related to the size of</p>
<p>a house. A maximum of 20 sq. m. may make sense for houses larger than 200 sq. m.</p>
<p>but other wise given the exemption of 10 sq. m. in FSI areas it would appear not to be</p>
<p>necessary.</p>
<p>Building above the second floor</p>
<p>2. The former City of Toronto By-law 438-86 allowed for vertical additions to be built</p>
<p>above the first floor in line with the existing walls even if those first floor walls were</p>
<p>closer to the side lot line than permitted. This was limited to the second floor and</p>
<p>intended to encourage vertical rather than rear additions in areas with bungalows.</p>
<p>ISSUE: .Regulation 10.5.4071 (3) allows for additions on existing walls but with</p>
<p>no limit as to the number of floors. This is an extension of the prior exemption. This</p>
<p>has implications for all areas of the City where there are no limits on the number of</p>
<p>storeys, but could combined with the 20 sq. m. exemption have implications for areas</p>
<p>with storey limitations. In areas of the former City of Toronto where side yards set</p>
<p>backs range from 0.45 to 0.90 and where existing buildings may be even closer to the</p>
<p>lot line going to a third floor could exasperate the existing issue of drafts for chimneys</p>
<p>even for areas that are presently two storeys.</p>
<p>POSSIBLE SOLUTION: Limit the exemption to the second floor only as was the</p>
<p>case in the former City of Toronto.</p>
<p>Cladding</p>
<p>3. 10.5.40.60(4) allows cladding to be places on the original exterior surface of the main</p>
<p>wall.</p>
<p>ISSUE: This provision was brought forward from 438-86. It was only allowed for</p>
<p>houses predating October 17, 1988. The new provision has no similar limit. A builder</p>
<p>could get permission to build a house and then add cladding since the reference is to</p>
<p>an original house. If this is combined with the provisions allowing for second floor</p>
<p>and plus additions on the first floor could create a loop hole.</p>
<p>POSSIBLE SOLUTION: Reintroduce an appropriate date for the original wall.</p>
<p>Alternatively introduce as elsewhere a requirement that the original wall and any</p>
<p>additions must be at least 5 years old.</p>
<p>FOR CITY OF TORONTO</p>
<p>Parking:</p>
<p>Regulation 10.5.40.40 (3) C) adds an additional exemption for lots with frontages</p>
<p>greater than 12m for a second parking space from fsi.</p>
<p>ISSUE: The former City of Toronto By-law only exempted the first space regardless</p>
<p>of the size of the lot. While many of the lots in the City are under 12m there are areas</p>
<p>in North Toronto, Forest Hill, Swansea and the Beach that have lots 12 or more</p>
<p>metres. In addition there are larger lots scattered throughout the City. This will permit</p>
<p>larger houses by adding roughly 20 sq m per house.</p>
<p>POSSIBLE SOLUTION: At a minimum, lots in the former City of Toronto should</p>
<p>be exempt from this relaxation.</p>
<p>While the Harmonized By-law has many good provisions these are issues which may impact</p>
<p>on your neighbourhoods. You should consider what position your group should take. These are not</p>
<p>the only issues but CORRA wanted to draw to your attention that you need to look into the draft</p>
<p>harmonized by-law.</p>
<p>There are other issues such as removing the prohibition of charging for parking in mixed</p>
<p>residential/commercial buildings which also has implications for tenants and condominium owners</p>
<p>in mixed buildings.</p>

<p>Many of you have written to me about your recent property assessments and expressed concerns regarding about how it will impact your property taxes.</p>
<p>&nbsp;</p>
<p>I have organized a public information night with representatives from the Municipal Property Assessment Corporation to discuss property assessment issues.</p>
<p>&nbsp;</p>
<p>MPAC staff will discuss:</p>
<ul>
<li>Property assessment in Ontario</li>
<li>The property assessment update</li>
<li>How residential properties are assessed</li>
<li>The relationship between assessment and municipal taxation</li>
<li>How to resolve assessment concerns</li>
<li>MPAC&#8217;s AboutMyProperty tool, which can be used by property owners to access information about their properties and obtain comparables.</li>
</ul>

<p><b><i>The information night will take place on Wednesday, February 27<sup>th</sup> at 6:30pm at the Banbury Community Centre.</i></b></p>
